consistent with forbearance authority granted the commission in 401 of 1996 act, however, and for reasons stated herein, we propose in notice to forbear from applying all section 214 authorization requirements to subject to cap regulation ("price cap carriers"), to that schedule companies, and to domestic carriers classified as -dominant, whether they are local or distance services. accordingly, we tentatively conclude that carriers should no longer be to obtain section 214 authorization for construction, acquisition, or of lines between domestic points, or over such . in of proposal, we tentatively conclude that 63. section 10(a) directs the commission to from enforcing a or provision of communications act when: (1) enforcement is necessary to that charges, practices, classifications, or by, for, or with or are just and reasonable and not unjustly or discriminatory; (2) enforcement is necessary to consumers; and (3) forbearance is with public interest. section 10(b) further instructs the commission to whether forbearance will promote competitive market conditions and enhance competition among providers of services.
if commission determines that forbearance will promote competition among providers of services, that may provide the basis for commission's finding, pursuant to 10(a)(3), that is public interest. we tentatively conclude that, under the first prong of three-part forbearance analysis set forth in 10(a), the imposition of 214 authorization requirements on price cap, average schedule, and non-dominant carriers is necessary to that charges, practices, classifications, or by, for, or with carriers or their services are , reasonable and not unreasonably discriminatory. this tentative conclusion is based primarily on presumption that cap and average schedule carriers, by of the rate regulation schemes applied to , are in ability to interstate telephone service rates. non-dominant carriers, by of competition in service areas also are in ability to rates. price cap carriers are in ability to a benefit from overinvesting in because rates for services are in with preset formulas that for and productivity growth. by prices rather than carrier profits, price cap regulation discourages overinvestment in and encourages carriers to costs and increase productivity.
we recognize that, under the commission's current price cap regulations, carriers may elect a " option, which could affect the rates charged for services. in , under our current interim lec price cap rules, a boc could select an -factor option that it to interstate earnings with customers that specified benchmarks and permits the boc to a -end adjustment if interstate earnings fall below a floor. therefore, price cap regulation of carrier that elected a option may not eliminate entirely that 's incentive to invest in facilities. such -plating" activities may have the potential to the carrier's costs and, therefore, to the carrier's obligation to its regulated profits with its customers. although price-cap regulation that a option preserves some of incentives toward "gold-plating" that rate-of-return regulation, we believe that forms of cap regulation nevertheless reduce these incentives. price cap carriers incur sharing obligations on scale once their profits exceed certain levels; only when the carrier enters its "100% sharing" zone would it reap the full benefit of in costs. this fact seems to indicate strongly that, in , the benefits associated with no-sharing option exceed the benefits of a option and strategically overinvesting in .
moreover, we expect that in for exchange and interstate access will provide additional incentives for price-cap lecs to their efficiency. therefore, whether a cap carrier elects a " or sharing" option, we tentatively conclude that regulation under section 214 is required to telephone service ratepayers adequately against potentially higher rates resulting from investment in facilities. accordingly, we tentatively conclude that " and "no sharing" price cap carriers should be alike for purposes of forbearance from the section 214 authorization requirements. we seek comment on tentative conclusion, and request that address whether we should distinguish price cap carriers that elected an -factor with sharing requirement from other price cap carriers.
